Client Guilty of S.18 GBH Avoids Custodial Sentence

Summary

Following an assault in January 2024, our client was remanded into custody and was charged with S.18 wounding with intent to do grievous bodily harm and possession of an offensive weapon. He was found guilty of both charges in light of the CCTV that captured the incident. However, after our expert representation at Reading Crown Court, the Judge was persuaded to impose a Suspended Sentence Order.

Our client accepted that he was in possession of the offensive weapon, a metal pole, and pleaded guilty to a lesser offence of S.20 grievous bodily harm without intent, asserting to have stopped striking the victim when he realised, he was bleeding.

At part of the trial in August 2024, led by Legal Executive Angie Deacon and represented by Mizan Abdulrouf of Church Court Chambers, our team submitted extensive psychiatric evidence in support of our client’s mental health difficulties.

Our client appeared before the court for sentencing in December 2024. Having spent just under a year in custody, he had made full use of this time and undertook extensive courses. He showed a dramatic improvement in character in court, bolstered by a supportive Pre-Sentence Report prepared by the Probation Service.

The Judge was most impressed with the mitigation put forward and was persuaded to impose a Suspended Sentence Order. This is an exceptionally rare and favourable outcome for such a serious case.

Thanks to our exceptional and diligent defence, our client avoided a lengthy custodial sentence, an extraordinary outcome. Our client was extremely grateful to Angie and the rest of the team for their hard work and dedication throughout this difficult period.
