Summary

Details of the Case

Our client and the complainant had met on an online dating website where they then agreed to meet in person. The complainant stated that during the date the two had kissed consensually but that our client had then proceeded to place his hands beneath her skirt and touch her inappropriately without her consent.

The complainant then pushed our client away and left. She stated that following this, she received a series of abusive messages from our client where she felt she had to block him for fear of safety.

During his police interview, our client gave a full comment interview where he denied all the allegations. While he accepted that he had placed his hands under the complainant’s skirt, he maintained that he had reasonable grounds to believe that she was consenting up to this point.

Prior to this, they had been having conversations of a sexual nature to which she was responding enthusiastically. When she expressed signs of discomfort, he stopped touching her immediately. He maintained that all contact with the complainant was consensual.

Our Defence

Our client was ultimately charged with two counts of sexual assault of penetration and one count of malicious communications. Managing Partner Nick Titchener was instructed on a privately funded basis for the court proceedings due to his reputation for effectively defending allegations of serious sexual assault.

Our client entered not guilty pleas to both counts of sexual assault but disputed the charge of malicious communications. After a thorough analysis of the evidence, Nick made an application to dismiss this charge entirely as none of the messages exchanged could be considered grossly offensive. This application was successful and our client’s indictment was reduced to the two charges.

Sexual assault by penetration is a serious offence under UK law and is often met with severe penalties upon conviction. Given the nature of the allegations, our client was at risk of a prison sentence potentially lasting up to four years if found guilty.

Court

Our client’s case was heard at Southwark Crown Court where he was expertly represented by Barrister Jane Bickerstaff KC. After a five-day trial, the jury returned not guilty verdicts in relation to both charges.
