Summary

A witness reported a minor collision involving our client’s vehicle to the Police. Our client was subsequently charged with three driving offences: failure to stop, failure to report, and driving without due care. Partner Massimo Trebar represented our client in court where, after strong representations, the two most serious of the charges against our client, failure to stop and report, were dropped. Our client pleaded guilty to the final charge of driving without due care, for which a minor fine and 3 penalty points was imposed.

Details of the Incident

The witness’ report claimed that our client’s vehicle had collided with a parked car, clipping the wing mirror, then continued driving. Our client later received a postal notice that she had been charged with driving without due care, failing to stop and failing to make a Police report.

Our Defence

Our client was shocked at the arrival of the postal notice, asserting she had not noticed the collision at the time. However, she was willing to accept her fault in the incident.  

Massimo took on our client on a privately funded basis, where he represented her at Stevenage Magistrates Court. He made strong representations to the Prosecution, asserting that our client had not knowingly driven away from the collision and urged that the charges for failure to stop and failure to report be dropped.

Thanks to the strength of these representations, the Prosecution agreed to drop these charges, proceeding only with the charge of driving without due care. Our client pleaded guilty to this offence, where Massimo then mitigated on her behalf. Prior to this incident, our client had held a full clean license for over fifty years and was a competent driver.

Ultimately, the Judge imposed a fine and three points were placed on our client’s license. Our client was very grateful to Massimo for his advocacy and support. Without Massimo’s strong representations, our client may have been convicted of all three charges and received a much harsher penalty.
