Have you been asked to attend a voluntary interview?
If you have been asked to attend a voluntary interview at the police station, you will be required to attend on a specified date, at a specified time. During the interview you will be asked to assist the police with their enquiries into a suspected criminal offence.
Also known as a caution plus 3 interview, a voluntary interview will be recorded and anything you say during the interview may be used as evidence in court, if the case proceeds that far.
A voluntary police interview is as serious as a police interview held under caution. You are entitled to receive independent legal advice from a solicitor whether you are required to attend a voluntary interview or a standard police interview. This will ensure your legal rights are protected and you are treated fairly.
While you are not under arrest at the time of a voluntary interview and you are free to leave the police station at any time (unless the police arrest you) you will still be cautioned before the interview takes place.
It’s very important to seek expert independent legal representation and advice for a voluntary interview to ensure you don’t incriminate yourself during the interview, or have your answers misinterpreted by a police officer who may have already decided you’re guilty of committing the alleged offence.
We have considerable experience in representing our clients at voluntary police interviews. We can support you through the interview and arrange the interview at a time and date to suit you. We will then arrange for you to be represented by a specialist criminal defence solicitor, whatever the alleged offence and wherever the interview takes place.
