Summary

Our client was charged with possession of an imitation firearm with intent to cause fear or violence, which he denied from the offset. When the case was listed for trial at Luton Crown Court, strong representations were made in relation to the Prosecution’s evidence, which resulted in no evidence being offered and ultimately a not guilty verdict was entered.

Details of the Offence

The complainant alleged that our client had entered her home to confront her and to demand money that was owed. When doing so, our client was alleged to have produced a firearm from his trousers, described as a handgun. The complainant claimed that she felt intimidated and threatened by his actions.

Our client completely denied this allegation. He maintained that he had only met the complainant on a few occasions and had never been to her address or threatened her with a firearm. Instead, he asserted that he had largely remained at his own address on the day in question.  

Our Defence

Our client was represented by Lawtons during his Police interview as well as at the Magistrates Court. During the Crown Court proceedings, our client was represented by Partner Joanne Cestaro, who carefully analysed all evidence to craft a strong defence. The CCTV footage of our client’s address confirmed that he had remained at his address at the relevant time.

Court

Our client’s case was heard at Luton Crown Court, where he was expertly represented by Barrister Clare Leslie of Lamb Building Chambers. Clare clearly communicated the issues in the Prosecution’s case, namely the absence of independent evidence that our client was present at the time of the incident.

After significant negotiations at court, the Prosecution took the position that the case could not properly proceed given the evidence. This ultimately resulted in no evidence being offered and a not guilty verdict was entered.

Our client was extremely happy with this outcome and grateful to both Joanne and Clare. Thanks to Joanne’s meticulous analysis of the evidence, we were able to identify the issues in the Prosecution’s case and the insurmountable problems, ultimately resulting in our client’s complete exoneration.
