Summary

Our client was arrested alongside two other co-defendants in relation to supplying class A drugs. She completely denied any knowledge of or involvement with the drugs and entered not guilty pleas. Partner Joanne Cestaro represented our client on this matter, where the Prosecution ultimately offered no evidence at trial and our client was acquitted.

Details of the Case

One of the co-defendants was our client’s partner of several years who had already been arrested in relation to drug supply. After his arrest, the Police searched the property our client shared with her partner, where they found over 1000 wraps of cocaine, a significant amount of heroin as well as quantities of cash.

Our client was then arrested and later charged with two counts of possession with the intent to supply class A drugs and two counts of being concerned with the supply of class A drugs.

Our Defence

At the Police Station and at her first court appearance, our client used the Duty Solicitor before formally instructing Partner Joanne Cestaro due to her expertise in defending complex and high-stakes cases.

Our client completely denied the charges against her. She maintained she did not have any knowledge of her partner’s involvement in supplying drugs at all, especially not at that scale and that she had no knowledge of there being drugs in the house. There was also no evidence of drug dealing on her phone.

Given the quantity and class of drugs in this case, our client was at risk of a significant prison sentence if she was found guilty at trial, potentially ranging up to 7 years’ and 6 months. This prospect was understandably extremely distressing for our client. Joanne made sure to provide constant reassurance and ensured that our client’s defence was meticulously prepared.

Court

Prior to our client’s trial, the two co-defendants had already pleaded guilty to the charges against them. Barrister Tamasin Graham of Lamb Building Chambers expertly represented our client at court and supported her through the proceedings.

Tamasin argued that the DNA evidence linking our client to the drugs was limited and inconclusive. In addition, any DNA found in relation to items associated with the drugs, our client was able to provide a plausible and reasonable explanation.

Overall, Tamasin determined that the Prosecution’s evidence was incomplete, inconclusive and insufficiently exhibited and that it therefore could not be properly relied upon. Tamasin invited another review of the Prosecution’s case, after which the Prosecution ultimately offered no evidence, acquitting our client of all charges.

Our client was extremely pleased with this outcome and grateful to both Joanne and Tamasin for all their support and guidance. This case is a testament to Lawtons’ expertise in defending complex matters as without Joanne’s meticulous case preparation and Tamasin’s robust advocacy in court, our client could have faced wrongful conviction and a severe penalty.
