No Further Action Achieved in Rape Case

Massimo Trebar, a partner in our private team, recently secured a “no further action” decision in a police investigation for a client accused of rape.

Our client faced allegations of grooming a 15-year-old girl online, enticing her to meet, and engaging in sexual intercourse. The case was further complicated by claims that the alleged victim had learning difficulties.

Despite the short notice, Mr. Trebar swiftly attended the police station and obtained detailed instructions from our client before the interview. He identified a clear defence: while our client had indeed made contact with the complainant online and subsequently met her, he genuinely believed she was over 18 years old. 

Mr Trebar advised that this constituted a valid defence under Section 9 of the Sexual Offences Act, as the client had no reasonable grounds to suspect otherwise. The website where they initially connected appeared to guarantee all participants were adults.

Navigating a police interview under caution in such a high-stakes situation demanded calm, clear advice and a thorough understanding of the Sexual Offences Act 2003. While a “no comment” approach might have seemed safer, it could have placed the client at a significant disadvantage later and potentially led to Crown Court proceedings.

Following Mr. Trebar’s guidance, our client provided a full account during the interview. Weeks later, after reviewing all lines of inquiry outlined in that interview, the police made a definitive decision to take no further action and concluded their investigation without pressing charges.
