Favourable Outcome with No SHPO in Indecent Images Case

In August 2021, Lawtons Solicitors undertook a complex case involving allegations under the Protection of Children Act. Our client faced a search warrant at his home by Essex Constabulary, based on allegations of accessing indecent images of children. Nick Titchener represented him at Chelmsford Magistrates’ Court where he was committed for the sentencing hearing at Chelmsford Crown Court with specialist Counsel in May 2024. As part of sentencing, the prosecution sought a Sexual Harm Prevention Order (SHPO) which is routinely ordered by courts in matters of this nature.  

When it came to imposing the sentence, the judge took into account our client’s voluntary rehabilitative efforts and made a rare decision. She decided not to give our client a SHPO, even though the prosecution had asked for one. The judge said she didn’t think it was necessary in this case. She exclaimed that this was the first time in her career as a judge that she had not given such an order when asked, recognising the extensive mitigation in this case.
