Paul Dillon, from our private client team, successfully secured a case dismissal at Bristol Crown Court before the trial commenced.

During the course of an acrimonious divorce and at the time when the family proceedings court was considering the issues of child contact and a financial settlement, our client was made the subject of allegations of assault by his wife. This scenario, unfortunately, common in our experience, often happens when relationships or marriages break down. Thankfully, we have a wealth of experience in recognising the nature and substance of allegations in this context.

Our client, charged with causing actual bodily harm, initially appeared at Bristol Magistrates Court before the case was referred to Bristol Crown Court.

Part of the prosecution case related to historic alleged domestic violence incidents. This required the prosecution to rely on third-party medical records from past events which can be particularly challenging to defend against, as they often lack immediate evidence and rely heavily on testimony and dated documentation.

As a privately funded case, Dillon was able to dedicate substantial resources to our client’s defence. His proactive pre-trial approach was crucial in securing a favourable outcome. He didn’t simply wait for the trial to present our case. Instead, he actively engaged in the disclosure process, meticulously examining all evidence the prosecution intended to use. He identified weaknesses in their case, particularly focusing on the admissibility of the historical medical records.

Dillon made strategic objections to the inclusion of this material, arguing that it constituted hearsay evidence and was being used improperly to bolster an otherwise weak case.

Lawtons early intervention and thorough pre-trial work ultimately led to the discontinuation of all charges. He preserved our client’s reputation and allowed him to continue his career in the financial services industry, where a conviction for a recordable offence would have resulted in termination of employment.

A successful outcome like this highlights the importance of challenging evidence and legal arguments at the earliest possible stage, rather than waiting for the trial itself. It also underscores the far-reaching consequences of criminal allegations and the importance of expert legal representation.
