Our clients were arrested and detained at Hammersmith Police Station, where they were represented by the Duty Solicitor. Following their Police interviews, both clients were released on bail, where unnecessary and disproportionate bail conditions were imposed. After transferring to Lawtons, Partner Paul Dillon was instructed on a privately funded basis and was able to have all bail conditions successfully removed.
At The Police Station
Following an incident at an event, our clients were both arrested and detained at Hammersmith Police Station. The bail conditions imposed on them following interview placed restrictions on their travel outside of the UK, with additionally requirements to attend their local Police Station on a weekly basis to “sign on”. These requirements significantly impacted their work and social lives.
Both clients were originally represented at the Police Station by the Duty Solicitor, who had clearly made very weak or perhaps even no representations to the Custody Sergeant prior to their release from custody in respect of the bail conditions.
Application to Remove Bail Conditions
Both clients chose to transfer to Lawtons following their arrest, where they instructed Partner Paul Dillon on a privately funded basis.
After thoroughly considering the Police Station attendance notes obtained from the Duty Solicitor and taking full instructions from both clients, Paul was able to commence the process of challenging the bail conditions placed on our clients.
Following a letter of representations to the Officer on the case, a formal application was made to Westminster Magistrates Court. The application argued that as both clients had no previous cautions or convictions or any history of committing offences while on bail, the bail conditions imposed were neither necessary nor proportionate.
Ultimately, Paul was able to persuade the court to remove ALL the conditions imposed, thereby leaving our clients on unconditional bail with no restrictions on their liberty until the bail to return date.
