Caution for Indecent Images at Investigation Stage in Wembley

In May 2022, the Metropolitan Police executed a search warrant under the Protection of Children Act 1978 after they received information about an individual who was under suspicion of uploading indecent images of children to the internet. 

During the search, several items were seized and subsequently examined. One of which was a substantial amount of indecent images of all categories found on the device of an 18-year-old. Following this, the police asked him to voluntarily go to Wembley Police Station to get interviewed under caution as a suspect in relation to the making of the indecent images. 

After undergoing thorough research, this individual and his family contacted Mr Titchener, Lawton’s Managing Partner, on a privately funded basis to assist and advise from this point onwards. Having obtained further information from both the police and our client, a plan of action was devised to achieve the best possible outcome. 

Consequently, our client admitted to downloading and viewing indecent material and had done so when he was much younger. Given this, it was clear to Mr Titchener that the circumstances and background needed to be carefully examined and placed into context. This was particularly important given that if our client was prosecuted, he would be liable to a starting point of a 12-month custodial sentence.

Mr Titchener attended the police station with our client, and a comprehensive explanation and history was provided. This was delivered for our client by a pre-prepared statement by Mr Titchener. 

Following the interview, both verbal and written submissions were made to the investigating team as to why our client’s case should not proceed to court. These were accepted upon a review by senior officers, and our client subsequently received a caution. 

The consequence of this out-of-court disposal means he avoids a conviction and his name on the Sex Offenders Register, meaning he can put this difficult episode behind him.
