Been asked to attend a voluntary police interview?

Also known as a caution plus 3 interview, a voluntary interview takes place at the police station. During the interview you will be asked to assist the police with their enquiries into a suspected criminal offence.  The interview will be recorded and anything you say throughout your interview may be used as evidence in court, should the case proceed that far.

Before the interview takes place the police will caution you, although you will not be under arrest. You can leave the police station at any time during the interview, unless the police choose to arrest you.

You are entitled to receive independent legal advice whether you are giving a voluntary interview or a standard interview, as a voluntary police interview is as serious as a police interview under caution. Expert advice is recommended to ensure you are not misinterpreted and don’t incriminate yourself with the answers you provide to the questions asked by the police, who may have already decided you are guilty of committing the offence you are being interviewed in relation to.

At Lawtons, we have plenty of experience in representing our clients at voluntary police interviews. We can arrange the interview with the police at a time and date to suit you,  then guide you through the interview process, where you will be accompanied by a specialist criminal defence solicitor.
